By using this site, the user unconditionally accepts the terms and conditions of use provided here and elsewhere on the site. Users are advised to carefully read all information on products and services in the relevant sections and FAQs.
 
This site is owned by EXPRESS MODIFY (“EM”). No material from this site or any other website owned, operated, controlled, or licensed by EM, its associates, or its sister concerns may be copied, reproduced, republished, transmitted, downloaded, uploaded, or used in any other manner for commercial purposes or otherwise without written permission from EM. Violation of this condition constitutes a breach of copyright and other proprietary rights of the Company and/or its associates or sister concerns or affiliates and will attract legal action as per the existing laws of the Government of India.
 
The products and services provided on this site are offered without warranties of any kind, either expressed or implied. EM disclaims all warranties fully. EM does not warrant that the products/services offered will be error-free, that defects will be corrected, or that this site or the server that makes it available will be free of viruses or other harmful components. Any warranties or after-sale services offered by manufacturers or vendors on any product shall be serviced directly by such manufacturers or vendors, and EM shall not be under any obligation to ensure compliance or handle complaints.
 
There may be additional charges such as gst, taxes, or duties that must be borne by the recipient at the time of delivery. Please note that EM does not control these charges.
 
For flowers, sweets, or other perishable items, delivery will be attempted only once. If the delivery is not executed due to an incorrect or insufficient address, recipient not being at home, address being locked, or refusal to accept, the customer will still be charged for the order. No refunds will be entertained for such items.
 
Since flower arrangements are handmade, there may be slight variations from the picture shown. However, we will ensure that we deliver the flower arrangement as closely as possible to the description or photograph shown.
 
Product specifications (weight, size, color, etc.) mentioned with the product photos are approximate. Most products are handmade items, and there may be variations between the pictures and the actual products. EM, at its absolute discretion, may deliver a similar or alternate product for reasons or exigencies beyond its control.
 
Under no circumstances shall EM be liable for any loss of data, loss of profits, or any damages, including indirect, special, incidental, consequential, or other damages resulting from the use of or inability to use the products/services offered on the site. Notwithstanding the foregoing, in no event shall EM be liable to the user for any damages, losses, or causes of action (including but not limited to negligence) exceeding the amount paid by the user to EM for the specific service/product.
 
To provide our customers with the most current information, EM will periodically make changes to the content and the products or services described on this site. Prices advertised on this site are for internet orders. Prices and the availability of items are subject to change without notice. Prices used on this site may not reflect actual selling prices in your area. We reserve the right to limit sales, including the right to prohibit sales to resellers. We are not responsible for typographical or photographic errors.
 
Users who have availed services through EXPRESSMODIFY.com by selecting one or more listed service providers may be contacted via SMS, email, phone call, or WhatsApp messages after their scheduled appointment for feedback or updates. EXPRESSMODIFY.com retains complete ownership of this feedback collection process.
 
Notwithstanding any terms, conditions, and disclaimers stated herein, in FAQs, or elsewhere on the site, any refund or payment by EM to the user or anyone acting on their behalf for any reason shall not constitute a waiver of any terms, conditions, and disclaimers and shall not set a precedent for similar future actions/claims. Such refunds/payments, if made, shall be subject to a 10% deduction for bank charges and processing overheads.
 
If the user has any questions, doubts, or confusion regarding any terms and conditions, they should seek clarification from us via email at support@EXPRESSMODIFY.com and wait for a written response before using the service.
 
For queries, concerns, or complaints related to compliance with Consumer Protection (E-Commerce) Rules, Consumer Protection Act, and Information Technology (Sensitive Personal Data or Information) Rules, please contact the Compliance Officer at grievance@EXPRESSMODIFY.com.
 
The user of EM is presumed to have read all terms and conditions herein and in the FAQ section and is deemed to have agreed, understood, and accepted unconditionally all terms, conditions, procedures, and risks of using the services, and cannot claim ignorance of any of them. In the event of any disputes, both parties shall endeavor to settle amicably. If the parties fail to settle within 30 days, the dispute shall be referred to a sole arbitrator, governed by the Arbitration and Conciliation Act, 1996. All disputes will be subject to the jurisdiction of the courts in Gujarat.
